Wedding Photography Terms and Conditions

Any variation to these terms and conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by Phil or Mary Bowles.

Booking retainer
A retainer of £175.00 is required at the time of booking. Dates can only be reserved when this retainer is paid. Please make cheques payable to Phil Bowles and send to Bridge Brook, Wendlebury, Oxon, OX25 2PW.

Balance payment
The outstanding balance is due 28 days before your Wedding Ceremony. Payment for albums, photographs, prints and other extras required after the wedding, at the time of ordering.

Creative licence
Phil shall be granted creative and artistic licence in choosing locations and poses used and his judgement in terms of photographic style and the number of photographs taken shall be deemed correct. Subject to weather and the availability and willingness of subjects Phil will do his utmost to take all requested photographs but cannot guarantee any specific picture nor incorporate any specific background, location or group arrangement.
Due to the variety of lighting conditions and digital sensor limitation some colours may vary throughout a set of images. Certain colours do not reproduce accurately on photographic paper, also prints made at different times and sizes may be variable in colour balance. Due to the quality and set up of individual monitors, images and prints may not match images rendered on a particular computer monitor. Images supplied will be made available for the default operating system Windows XP Home edition.

Copyright
The 1998 Copyright, Designs and Patents Act assigns copyright to Phil Bowles trading as Bridge Brook Photography. Copyright in all photographs including, but not limited to, photographic prints and files remains at all times the property of Phil unless the copyright has been purchased by the clients. Phil reserves the right to use any picture for promotional and display purposes unless this has been specifically agreed to the contrary in writing. The purchase of the CD of images gives the client the licence to print but does not pass on the copyright of those images.

Exclusivity
Family, friends and other guests are encouraged to take photographs throughout the day but Phil Bowles shall be the sole professional still photographer on your wedding day.

Force majeure
In the unlikely event of total photographic failure, injury, sickness or circumstances beyond Phil Bowles’ control his liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. Phil Bowles has full Public Liability and Professional Indemnity Insurance.

Cancellation
If Phil has to cancel this contract for reasons beyond his control, (death, injury, sickness etc.) his liability shall be limited to a full refund of all monies paid.

Should the wedding be cancelled for any reason, as compensation for loss of income for Phil Bowles, the following charges apply as a percentage of the total fee due; Less than sixty days before the wedding ceremony 100%, sixty one to ninety days before the wedding 75%, ninety one to one hundred and twenty days before the wedding ceremony 50%. If more than one hundred and twenty days the retainer will be forfeited unless another booking is taken for that date.
Should the cancelled wedding turn out to be a postponement and subject to Phil’s availability, all money paid may be applied to the new wedding date and the total fees chargeable shall be the fee which applies at the time of booking the new wedding.

Complaints
Any complaints must be received in writing within seven days of receiving the products purchased. This includes photographs, disc, albums, frames and any other special services that have been agreed.

Privacy
Your name and wedding details will be stored by Phil on a private internal database and will not be made available to other companies or individuals. Should you wish to have your details removed from the database please advise Phil in writing.
